Malaysia is one of Asia's biggest employers of foreign labour. But recently, cases of deaths, abuse and forced labour have come to light. What is going on? Who is protecting these migrant workers?
Awareness Raising for Trade Union Officials
An ILO Country Programme
Malaysia ratified the International Labour Convention 81 (C81) in 1963 – Labour Inspection.
Labour Inspection is the core of labour relations. The main objective of Labour Inspection is to secure the enforcement of the law on conditions of work and protection of workers including occupational safety and health.
A total of 51 MTUC Affiliates participated in this half (1/2) a day programme aimed at creating awareness of this important aspect in our labour relations system.
This was followed by the participation of 18 MTUC Affiliates in a Tripartite Programme – Strategic Compliance Planning in Malaysia along with the Malaysian Employers Federation and the Ministry of Human Resources officials particularly Labour, Department of Occupational Safety (DOSH) and Health and Social Security (SOCSO).
Our Affiliates vehemently conveyed to ILO that under the previous regime, trade unions and MTUC was never engaged to discuss about Labour Inspection. In fact, trade unions and MTUC was completely shut out of this process. This is the situation till to date.
We also strongly expressed our displeasure on the followings to both MEF and the ILO representatives:
1. The manner in which trade unions and MTUC was kept out of this critical labour relations activity which in itself is a direct non-compliance of Convention 81 and
2. The impact of the non-compliance on the workforce at large in Malaysia.
ILO should continue to engage MTUC and bring about greater awareness on this aspect as it is critically necessary for Trade Union’s to fully understand this important labour inspection in order to maintain check and balances for industrial harmony at the work place.
