Malaysia is one of Asia's biggest employers of foreign labour. But recently, cases of deaths, abuse and forced labour have come to light. What is going on? Who is protecting these migrant workers?
The termination is violating The Freedom of Association and Protection of The
Right To Organise (ILO Convention Number 87), The Right To Organise and Collective
Bargaining (ILO Convention Number 98), and Act of The Republic of Indonesia,
Number 21 Year 2000 concerning Trade Union.
<p>The union was born on January 15, 2005. Since that time until now, the employer
has been intimidating the union leaders according to union activities to demand
the worker rights. </p>
<p>But for example, Aripin is laid off because of his activities in the union.
He demanded the decent wage at the beginning of this year when the union was
established. The latest case was the worker right to have social security fund
(Jamsostek). He has organised the demonstration to demand Jamsostek to the management.
To silence the demand, the employer has bribed him and 8 leaders of the union
for 20 million rupiahs (US$ 2,000) each. But they have refused the employer
offering. Untill Aripin was sacked by the management last week because of his
activity to take the photograph inside the factory. It is the common thing that
every worker does, just for memorable things. For the taking picture, Aripin
was sued to the police. And then, Aripin has the obligation to report to the
police once a week regularly. This situation was taken by the management to
terminate Aripin because of his status as a criminal.</p>
<p>Moreover, the employer has also intimidated the members of the union when they
have made the strike to organise solidarity when Aripin has sacked. The members
were forced by the management to sign the letter which state not to make the
demonstration again. If they do again, they will be laid off by the management.</p>
<p> Regarding to the worst condition of freedom of association, we demand:</p>
<p><b><font size="4" color="#FF0000">Reinstate Aripin (Emon) immediately.
Stop intimidating the union activities to demand the worker rights.
The employer must respect and implement the freedom of association for the workers.
