PETALING JAYA, Dec 14 (Bernama) — A cleaning worker supply company was fined RM30,600 by the Magistrate’s Court here today for failing to comply with the Minimm Wage Act 2016.
Magistrate Muhammad Azali Ibrahim meted out the punishment to Syarikat Sinar Jernih Sdn Bhd, represented by its director, Ibrahim Desa@Din, 48, after he pleaded guilty on behalf of the company to 17 charges involving 17 workers.
For every charge, the company was fined RM1,800.
The company paid the fines.
According to the charges, the company, as the employer, had failed to pay the basic salary as stipulated in the 2016 Minimum Wages Order, namely, RM1,000 for July this year.
Nine Indian nationals, aged between 22 and 40 years, and eight local workers, aged 29 to 55 years, were affected.
All the offences were committed at the premises of the company at No. 41G, Petaling Utama Avenue, Jalan PJS 1/50, here on Aug 1.
The charges were framed under Section 43 of the National Wages Consultative Council Act 2011 (Act 732) which provides for a maximum fine of RM10,000 for every worker affected.
Earlier, Selangor Manpower Department prosecution officer Siti Nur Alifah Hairudin urged the court to impose a commensurate punishment.
“This is the first case in Selangor, and as an employer, the company should have been more sensitive to the announcement by the Government,” she said.
However, Ibrahim appealed for a lighter sentence, saying the company had started paying the wages in accordance with the stipulated minimum amount since September.
According to the facts of the case, after a detailed investigation was conducted, the company was found to have paid only RM900 in basic salary for July 2016 and not according to the 2016 Minimum Wages Order, that is RM1,000, under the National Wages Consultative Council Act 2011 to the 17 workers.
